Department of Revenue Issues New Tax Filing Requirements for Condominiums
2/1/2010
The Commonwealth of Massachusetts has changed how Massachusetts condominium associations are taxed, effective for tax years beginning on and after January 1, 2009. While the changes do not completely restore the taxing structure to what it was prior to a 2008 tax law change, it does largely remedy the unintended consequences caused by a 2008 tax law change that would have significantly increased taxes on all Massachusetts condominium associations.

A STORM ON THE HORIZON: PROPOSED STORMWATER REGS AND ITS AFFECT ON CONDOMINIUMS

The Massachusetts Department of Environment Protection (“DEP”) has proposed new stormwater management regulations that could have a drastic impact on condominiums. The idea behind this new program is to reduce stormwater runoff from impervious surfaces, such as parking lots and roofs, which eventually pollute rivers and streams. The new regulations would require that private property owners take certain steps to mitigate and control pollutants from stormwater runoff.

CAI Massachusetts Legislative Action Committee (MALAC) Involved in
11/19/2009
On November 19th, the Massachusetts House and Senate passed legislation that includes provisions restoring the tax status for most residential condominiums to their status prior to 2008 changes.
